Terms of Service

The Japanese version of these Terms is authoritative. Translations into other languages are provided for reference only, and in the event of any discrepancy, the Japanese version shall prevail.

These Terms of Service ("these Terms") set out the conditions for using the web service "cubepic" (including https://cubepic.hakadoru.ai and all files and data delivered in connection with it; the "Service"), provided by Asalabo ("we" or "us"). Please read these Terms before using the Service.

Article 1 (Application)

  1. These Terms apply to all relationships between users and us in connection with the use of the Service.
  2. Notices, help content, and explanatory pages that we publish on the Service form part of these Terms. The same applies to the "Privacy Policy" and "About This Site".
  3. A user is deemed to have agreed to these Terms upon using the Service.

Article 2 (Definitions)

  1. "User" means any person who uses the Service having agreed to these Terms.
  2. "Output" means the files that the Service generates in the browser in response to a user's operations and that can be downloaded (including photorealistic images in PNG, solution animations in APNG, and ZIP files of step thumbnails).
  3. "Material Data" means the packs of image assets that we produce and distribute for use in compositing Outputs, and the data used for solving and legality checking.

Article 3 (Composition and Characteristics of the Service)

  1. The Service is a static website that provides generation of photorealistic images of Rubik's-Cube-type twisty puzzles, legality checking of configurations, presentation of solutions, generation of solution animations, and a solve game.
  2. The Service does not require account registration or login, and does not maintain a persistent database for individual users. Image compositing, legality checking, solution search, and animation encoding are all performed within the user's browser (WebAssembly).
  3. Configurations, color schemes, target states, and other data entered by a user are not transmitted to our servers and are retained only in the user's browser localStorage and in the URL (query string and fragment). For details, see the "Privacy Policy".
  4. The Service is provided free of charge except where we expressly state otherwise. We may change the content, features, supported puzzle types, and screen layout of the Service without prior notice to users.

Article 4 (Use of Outputs)

  1. Users may freely use an Output generated through the Service, whether or not it has been edited, modified, cropped, or combined with other material, for private or commercial purposes, including on their own websites, materials, printed matter, and social media. When using free assets, please include the credit “cubepic — https://cubepic.hakadoru.ai/”. You may place it in the text, a caption, or a video description; it does not need to be embedded in the image. No notice to us or request for permission is required.
  2. Notwithstanding the preceding two paragraphs, the following uses are not permitted.
    • Representing to a third party that the user holds exclusive rights in an Output, or preventing use of an Output by a third party
    • Creating the false impression that an Output is an official work or endorsed product of us or a third party
  3. We are not liable for any dispute arising between a user and a third party in connection with the use of an Output.
  4. This Article governs only Outputs; extraction or redistribution of the Material Data itself is not permitted (Article 6).

Article 5 (Solve Game Records)

  1. Solve game records are not stored on our servers; they are self-contained in the form of a URL and QR code that the user carries away. We do not retain records and are not liable for whether they can be restored.
  2. Records are affected by the performance and condition of the user's browser, device, and input equipment. We do not guarantee the accuracy of recorded times, move counts, or other values, and records on the Service are not official records of any competitive organization.
  3. Falsifying a record, or publishing or presenting a falsified record as genuine, is prohibited.

Article 6 (Prohibited Conduct)

In using the Service, a user must not engage in any of the following conduct.

  1. Conduct that violates any law or public order and morals
  2. Extracting, reproducing, redistributing, or selling Material Data (excluding use of Outputs under Article 4)
  3. Decompiling, disassembling, or reverse-engineering the programs constituting the Service, beyond the extent permitted by law
  4. Placing an excessive load on the Service's delivery infrastructure through scraping, crawlers, automation tools, or similar means
  5. Providing a copy of the Service to a third party, or redistributing it in a manner likely to be mistaken for the Service
  6. Infringing the intellectual property rights, reputation, or other rights or interests of us or a third party
  7. Gaining unauthorized access to, interfering with, or destroying the functions of the servers or network of the Service
  8. Any other conduct that we reasonably determine to be inappropriate for the operation of the Service

If a user violates these Terms, we may restrict that user's use of the Service without prior notice. This measure does not preclude us from claiming damages.

Article 7 (Intellectual Property Rights)

  1. Copyrights and other intellectual property rights in the software, screen design, explanatory text, Material Data, and all other components that constitute the Service belong to us or our licensors.
  2. We grant users only a non-transferable, non-sublicensable, non-exclusive right to use the Service in accordance with these Terms. These Terms do not transfer our intellectual property rights to users.
  3. The conditions for using Outputs are as set out in Article 4, and this Article does not restrict them.

Article 8 (Advertising and Cookies)

  1. The Service displays advertisements served through Google AdSense. Third-party ad providers, including Google, may use cookies to serve advertisements based on information about a user's prior visits to the Service or other sites.
  2. The Service uses Google Analytics (GA4) to understand usage and improve the Service, and uses cookies for that purpose.
  3. Details on disabling personalized advertising, opting out of analytics, and declining cookies are set out in the "Privacy Policy". Users may disable cookies through their browser settings; the operational functions of the Service will continue to work even in that case.
  4. The content of advertisements is determined by the ad providers, and we are not liable for that content.

Article 9 (Third-Party Services and External Links)

The Service uses content delivery networks, ad delivery, analytics, and other third-party services. The Service may also contain links to external sites. We are not liable for the content or availability of third-party services or linked sites.

Article 10 (Changes, Suspension, and Termination of the Service)

  1. We may suspend or discontinue all or part of the Service without prior notice to users due to system maintenance, failure of delivery infrastructure, force majeure, or other causes.
  2. We may terminate all or part of the Service upon reasonable advance notice.
  3. We are liable, in accordance with Article 11, for any damage caused to users under the preceding two paragraphs.

Article 11 (Disclaimer of Warranties and Limitation of Liability)

  1. The Service is provided "as is." We do not warrant that the Service is free of defects, whether in fact or in law (including with respect to safety, reliability, accuracy, completeness, validity, fitness for a particular purpose, absence of errors or bugs, and non-infringement of rights).
  2. Legality checking and solutions are computed results based on publicly available theory and implementations, and their accuracy or completeness is not guaranteed. In particular, the sequences returned by the solver are presented after verifying that they reach the target, but are not always the shortest possible sequence.
  3. Because the Service runs within the user's browser, the quality, processing time, and success of an Output depend on the condition of the user's device, browser, and network connection. We make no warranty in this respect.
  4. We are not liable for any damage incurred by a user in connection with the Service, except where such damage results from our willful misconduct or gross negligence.
  5. Any provision of the preceding paragraph or elsewhere in these Terms that exempts or limits our liability shall not apply to the extent it is rendered invalid, where the user qualifies as a consumer under the Consumer Contract Act of Japan, by that Act or other mandatory statutory provisions. Even in that case, we are not liable beyond the scope of damage that would ordinarily arise.

Article 12 (Trademarks)

Rubik's Cube is a registered trademark of Rubik's Brand Ltd. The Service is an independent service unaffiliated with that company or with any other puzzle manufacturer or competitive organization. Trademarks and names of other companies appearing on the Service belong to their respective rights holders.

Article 13 (Paid Features)

As of the last update date of these Terms, all features of the Service are provided free of charge, and we do not charge users any fee. If we introduce paid features in the future, we will separately establish and post on the Service the applicable conditions of use, fees, payment methods, and the disclosures required under the Act on Specified Commercial Transactions of Japan. Even in that case, we will not retroactively charge for features that were previously provided free of charge.

Article 14 (Use by Minors)

The Service may be used without age restriction. However, if a minor uses the Service, they should do so with the consent of a legal representative.

Article 15 (Amendment of These Terms)

  1. We may amend these Terms where the amendment serves the general interests of users, or where the amendment does not contravene the purpose of the contract and is reasonable in light of the necessity for the amendment, the appropriateness of its content, and other circumstances.
  2. When making an amendment under the preceding paragraph, we will post the revised content and its effective date on the Service.
  3. If a user uses the Service after the effective date, the user is deemed to have agreed to the amended Terms.

Article 16 (General Provisions)

  1. If any provision of these Terms is held invalid or unenforceable, the validity of the remaining provisions is not affected.
  2. Our delay in or failure to exercise any right under these Terms shall not be construed as a waiver of that right.
  3. The Japanese version of these Terms is authoritative. In the event of any discrepancy with a version in another language, the Japanese version shall prevail.

Article 17 (Governing Law and Jurisdiction)

  1. These Terms are governed by the laws of Japan.
  2. The Nagoya District Court shall have exclusive agreed jurisdiction as the court of first instance over any dispute arising in connection with the Service or these Terms.
